1. Procedures for notarizing land sale / purchase / transfer contracts
Records of both parties must include:
- Identity card / citizen ID / passport (still valid);
- Registration book;
- Marriage certificate (in case of spouse), if the party is single, there must be a certificate of marital status issued by the People's Committee of ward where household registration is registered (purpose of purchase clearly sale of real estate or civil transactions).
- Documents about property: Certificate of land use right / Certificate of ownership of houses and land use rights / Certificate of land use rights of houses and other land-attached assets .
- Note: When notarizing all documents are original.
2. Place of notarization contract:
Pursuant to Article 42 of the Notary Law stipulates: “Notaries of notarization organizations or professions are notarized notarizing contracts, transactions on real estate within the provinces or centrally run cities where they are organized. notarization profession is headquartered, except in the case of notarization of the document, the written refusal to accept the estate being real estate and the power of attorney relating to the exercise of rights to real estate ”.
As such, the buyers and sellers must go to a notary practice organization (including a notary office or a notary office) headquartered at the address of the house and land to sign a notarization / transfer contract.
3. Time limit for performance to name:
Pursuant to Clause 6, Article 95 of the Land Law: “... within 30 days from the date of change, the land user must carry out the procedure for registration of change ....”
Transfer is one of the changes subject to change registration as prescribed in Clause 4, Article 95 of the Land Law.
Thus, no later than 30 days from the date of signing the notarization contract, the parties must carry out the declaration procedure to register the name transfer.
