The criteria for a lawyer are stipulated in Article 10 of the 2006 Law on Lawyers as follows: “Vietnamese citizens are loyal to the Fatherland, abide by the Constitution and laws, have good moral qualities, have a bachelor's degree in law, having been trained in the lawyer's profession, having passed the apprenticeship in practicing law, having the health to ensure the practice of lawyers, may become lawyers. " Specifically:
1. Having a bachelor's degree in Law
Holders of the bachelor's degree in law prescribed in Article 10 of the Law on Lawyers are those who possess a bachelor's degree in law from a Vietnamese higher education institution or a bachelor's degree in law from a university. foreign higher education granted and recognized in Vietnam in accordance with the regulations of the Ministry of Education and Training and international treaties to which the Socialist Republic of Vietnam is a member.
2. Having a certificate of graduation from a lawyer's job training
Holders of the bachelor of law degree may attend the lawyer's job-training course at a lawyer's job training institution (Judicial Academy).
The time for legal profession training is twelve months. Persons who complete lawyer's job-training programs shall be granted certificates of lawyer's job-training graduation by lawyer's job-training establishments.
3. Practicing law practice
After graduating from a lawyer training class, individuals are required to register an apprenticeship at a lawyer practice organization for a period of 12 months (except for cases of exemption or reduction of the probationary-practicing period of lawyers). as stipulated in Article 16 of the 2006 Law on Law, amended 2012).
4. Satisfying the requirements at the examination for the completion of the lawyer's practice practice:
After completing the apprenticeship period, the apprentices are allowed to take part in the examinations for all of their practicing lawyers. Those who have passed the examination of the lawyer's apprenticeship test results shall be granted the examination certificates of the lawyer's apprenticeship by the Examination Council.
5. To be granted a certificate and join a Bar Association, to be granted a Lawyer practicing card:
If he / she passes the test of the probationary practice period, the individual shall make a dossier as prescribed to apply for a law practice certificate issued by the Ministry of Justice and a lawyer's practice card issued by the Vietnam Bar Federation. Male level.
Holders of a law practice certificate may choose to join a bar association to practice law.
6. Having good health to practice law, may become a lawyer
