1. What is copyright?
According to the Intellectual Property Law, copyright is the right of individuals and organizations to works created or owned by them. Copyright is recognized for literary, artistic and scientific works such as books, lectures, musical works, sewing works, cinematographic works, theatrical works, cinematographic works and works of art. artworks and applied artworks, photographic works, architectural works, computer soft works, etc.
Copyright arises from when a work is created and expressed in a certain material form, irrespective of content, quality, form, medium, language and work announced or pre-published, registered or preferred.
Although it is not a compulsory requirement to enjoy the rights, the registration of copyright with the Copyright Office - the Arts and Literature will facilitate the person who is recognized as the author / owner when There is a dispute occurred.
Copyright owners defined in Article 36 of the Intellectual Property Law include:
- Organizations and individuals that have copyrighted works include those who directly create the products and the copyright owners.
- Vietnamese organizations and individuals.
- Foreign organizations and individuals that have works created and expressed in certain material forms in Vietnam.
- Foreign organizations and individuals whose works are first published in Vietnam.
- Foreign organizations and individuals that have works protected in Vietnam under the "International Treaty on Copyright of which Vietnam is a member" (Article 27).
2. Register copyright

Any person who wants to use a copyrighted work must obtain permission from the author. However, if they intentionally violate copyright, they will be handled according to the provisions of law.
3. Application for copyright registration
Authors and copyright owners may directly or authorize other organizations or individuals to apply for copyright registration.
Copyright registration applications include:
- Copyright registration declaration (the declaration must be made in Vietnamese language and signed and fully written by the copyright owner, copyright owner, related right owner or authorized person. information about the applicant, author, copyright owner; summary of the content of the work, performance, phonogram, video or broadcast; author's name and author's work used as the author's work derivative works if the work is registered as a derivative work; time, place, form of publication; guarantee of liability for information stated in the application.
The Ministry of Culture and Information provides a form of declaration of copyright registration;
- Two copies of the copyrighted work;
- Power of attorney if the applicant is an authorized person;
- Documents proving the right to file an application, if the applicant enjoys that right of another person as a result of inheritance, transfer or inheritance;
- Written consent of the co-authors, if the work is co-authored;
- Written agreement of the co-owners, if copyright.
4. Work performed by Dai Viet Law
- Customers provide information to Dai Viet Law upon request.
- Dai Viet Law prepares documents and sends customers to check information, print and sign as instructed.
- Dai Viet Law represents filing at Copyright Office, receives results and returns to customers in accordance with the agreement in the service contract between the two parties.
